Attorney General J.B. Van Hollen has joined Nebraska and 40 other states in opposing efforts by General Motors Corporation to use federal bankruptcy law to circumvent state statues designed to protect automobile dealers from heavy handed practices by manufacturers.

We are writing to ask you to support S 1304, the Automobile Dealers Economic Rights Restoration Act of 2009, which has been introduced by Senators Grassley, Kerry, and Brownback. The legislation restores the franchise agreements of dealerships let go during the American automakers’ bankruptcy proceedings. This bill was brought to our attention by our constituent Russ Mikels, who owns Mikels Chevrolet Buick Pontiac in Bloomfield, Iowa.

“The Montana dealers I’ve spoken with have serious concerns over the way the Auto Task Force has handled these closures, especially when many are reporting profitable bottom-lines,” Rehberg said. “Car dealerships are often one of the largest employers in rural communities, and these job cuts are counter-productive to economic recovery efforts.”
